You're quite correct in stating that I had not written a correct sentence though, It should have read that the selling dealer would have failed in their duty of care for delivering a bike that had existing defects.

For instance, amb67 has said the dealer has a duty of care to deliver a bike with a defect. Obviously it was a typo, but that makes no sense and if you wrote that in a letter to the dealer he'll laugh his ass off.
