Just got a notice of intended prosecution.

103mph in a 70 zone - Cumbria, when appleby fair was on.

It must have been a sneaky camera, cos my mate never spotted it.

Any advice that would have a favourable outcome would be gratefully accepted.

In my favour are - Clean liscence for nearly 20 years, need the car for work.

Is it better to have a solicitor or just own up & admit it was stupid.

If you "own up" you will be banned.

Go see a brief, and get a letter that categorically states no licence, no job. That might save you.
 
I got done for 99 in a 70 years ago, in the car.

Bloke in front of me 103mph, had a work colleague with him to vouch for the fact that he needed the car for work and they gave him 6 points and a bigger fine.

I had 6 points and £250. That was 16 years ago I think.
 
I'd go to court and pretend to be that Mr Loophole chap. Be polite, plead for forgiveness, defend your character etc and ask to see the speed gun calabration? certificate.
I bet they never copped any of them un taxed, uninsured stolen vans, caravans and wagons up there that weekend did they ???
 
I reckon you are looking at a ban,whatever you plead.:thumbdown
You might get away with a hefty fine,points but no ban if you can prove "extreme hardship".
i.e,no licence,..no job,...kids to feed etc.Also be humble in front of the magistrates,be very sorry for your actions,...moment of madness,...got carried away,...etc,etc.

Get a good solicitor, they no what to say and how to say it. like BF says dont just throw ur hands up to it .There but for the grace of god and all that, Fingers crossed for yer.

Bad news Olaf min...thats the gamble we awe live wi bein bikers at the tap end o the speed pyramid ah guess. Best o luck wi yer pendin meetin wi the beak...an a reckon a brief might be beneficial, expensive nae doot but mibbe will ken the ropes better.
 
You can always say you were selling and allowed the guy to test ride and you have lost his details etc . ( Start wearing another jkt and hat)

failing that I think you are up the Creek without the paddle.

90 + on the motorway is a ban
 
No its 100+ unless they have changed something. As I said above, I was done for 99 back in the day and had 6 points £250 fine.
 
50 kph over here, and they take your bike with the license if the po-po catches you... ******* hell mate. I hae mah fingers crossed fer ye.
 
what charges are they doing you for?
got done at 132 in a 70,only done for excessive speed
judge could only give a max of 6 points per charge
a good brief is worth the cost

Did you receive the NIP in the statute 14 days of said offence? (if not that is GOOD news)

Have you replied to it yet?

There are lots of website for this sort of thing I suggest you visit them before YOU DO ANYTHING.

DONT plead not guilty just to go to court to speak to them personaly, do it with a letter outlining the circumstances.
 
Have you tried explaining that you ride a T.
Tell that bloody judge to have a go on one and see if he can keep it within the speed limits.

Some people just dont know what we have to put up with
 
Over 100 in a 70 is a 28 day ban 6 points and can be over 1000pounds fine. Spoke to a solicitor once though and she said I you get any speeding fines come straight to me.

Previously when I had one I asked for when the gun was last calibrated, photographic evidence etc and they supplied it all. Best man up to it rather than say it was someone else like others have said or that can open another can of worms.

Either way always best to keep below the 100 limit
 
Nick Freeman aka Mr loophole got Jordan off with a speeding ticket previously, very clever bloke.

They send her two NIP's she failed to fill or return either.

She was summonsed to court.

Then the lady who sends out the NIP letters appears in the court to give evidence, Mr Freeman then argues her evidence is "hear say" as she did not witness the offence, so they could not prove the letters were ever sent out within the specified 14 days, so no further action.

Any solicitor will take your money but you want someone who knows TRAFFIC LAW.

In some countries they just send the keeper a fine as they dont know who the driver is/was, however in our coutry your made to "incriminate yourself" by the NIP, failing to disclose the driver at the time of the alledged offence is a seperate offence which carries 6 points and a fine.

Some guy went to ECHR arguing he should not have to incriminate himself on an NIP and its for the defence to prove he was driving/riding. He lost.
 
To give a bit of background I got tabbed at 104 on a dual carriageway back in about '95.

I went to a brief adn followed his advice, got a letter signed by a director at the company I was working (I am freelance) which said no licence, bye bye.
I was given 6 points in court.
Pleaded no licence no job, the magistrates asked me about taking holiday (I expalined self employed, no work no pay) family member driving me? etc.
I got a £500 fine, plus court costs and my brief to pay, but kept the licence.

Don't take the piss denying it was you etc, contempt of court is custodial.
The downside of "Mr Loophole" is that the courts know him and it sets the bias against you. Faceslider (AF1) got done for wheelies and was due on totting up, ISTR he used Nick Freeman (or someone of that ilk) and still got banned despite actually losing his job, having a pregnant wife etc, etc. So there are no gaurantees.
 
I got done exactly the same 103 in a 70 M4 Cardiff. was given a load of bollox about getting the photos & looking for where the crosshairs were aimed. went down the road of getting legal advise who basically said. Take the wrap unless you're minted & can afford thousands in legal expenses. I ended up with an 18 day ban & about a £180 fine. That was in Neath Mid Glamorgan. Not like when I got done for doing 135 on the way to Goodwood festival of speed some years ago. Imagine the officers face when I replied to the question "where you going in such a hurry." That time I got a six month ban & £600 fine. Totting up took priority at the time I was sitting on 9 points I think. Court was in Andover, Hampshire.

Looks like I may be a pedestrian for a while.

How does this roll out, I assume it will be a court appearence, over in Cumbria somewhere.

If its any sort of ban, I assume it will be straight away, better take BFH (bus fare home).

Is a letter from a brief OK or does he / she have to be present (£££)

Can anyone suggest someone in Geordie Land that may be able to help, or is it pot luck from the interweb.

PS, Newelly, what is the nice prize for getting it right ?
 
Whats happens if you dont turn up in court ?
Assuming you are going to get a ban and a fine, you would be better staying at work, earning some money to pay for the fine, and saving yourself the BFH.

Right heres my guess 60 days £750 fine if i win newelleys prize of £500 im donating it to olafs fine fund!!!
