1-0 to the Elderly.

1 mintue im riding down the road in a nice seated position, next minute I was on the floor in a seated position. I'm at a cross junction, light goes green, so I turn left, as I get the bike upright and just starting to accelerate (to about 20mph) this fat ***** who isn't elderly at all, jumps out onto the road not looking in my direction at all, I slam the bajesus out of the brakes to try and avoid hitting her, the front wheel let go, and I whacked my head and shoulder on her scooter, she looks at me, and is ready to drive off!

I stopped her and straight away got on the phone to the police/ambulance, got a couple of witnesses saying she jumped onto the road even though the walking man sign was RED! she wouldn't admit libility, but I plan on giving her a call in an hour and recording the conversation and try and get her to admit wrong.

I've got a stiff neck, shoulder, elbow, knee all bruised.

The bike is ******, tank, panels, exhaust swingarm,, forks, all ******, the OZ wheels look fine thank god! only just put those on!!

LUCKILY Her mobile scooter thing has insurance so I'm claiming, I've got all injuries recorded at hospital and i've got legal cover on my insurance so Im going to try and get as much as I can out of her, see what happens I might get bugger all if she won't admit shes wrong, fat ****.
 
Stupid old slapper! i'd try and get as much as I can out of her too! some old people are so old, they think they're always right and no matter what you do your always wrong. I hope she gets the book thrown at her, not to mention a zimmer frame, false teeth, wig, and especially that feckin scooter! :rant:angry:pirate:puke:jack:bash:coocoo:angry
 
Senna, sorry to here this fella, at least you're not too badly hurt. I don't know how she cannot admit liability as it was she who pulled out in front of you, on a red pedestrian crossing too. You have witnesses who will back your story. Hope you get it sorted fella and go for the maximum amount claimable including your bike kit and expenses etc...

Like you say, I hate those fat ***** that use mobility scooters because they are too fat and stink of piss to loose some weight.

Yeah im not going to hold my breathe, worse comes to worse, im thankfully ok, just bits of plastic damaged really,

i've dropped it on the right side, so if anyone has any bits that might help me along like a brake lever, standard exhaust, right hand clipon, i've still got abit of money so should be able to get her back up again,

the best thing about this thread is the adverts that come up for mobility scooters etc at the bottom. Tragic irony.

Good luck with the claim. You never know you may get a new bike out of it! Any scraping of frame or swingarm? That'll be a write off then!

Im already thinking about what I want it to look like, so I may just get it sorted sooner than I planned, if I can get anything out of her I'll be well chuffed but for now, I like :)

Crap, just what you don't need.

As long as the witnesses come good (and there's no reason they shouldn't) you should have a pretty good case.

Down side is that even with your legal assistance it's going to take an age to sort. Keep hassling your legals or your case will sink to the bottom of their things to do pile.

Get receipts for every expense even remotely attributable to the accident and include it in your claim.

However, if your claim gets to something like 40% of the book value you're into writeoff country. If the bikes not too badly damaged you should be able to buy it back at the scrap value and repair it cheaply.

If you just tip into the writeoff zone, drop some items you can fix yourself to get back into the repair zone.

And on some other board that lady is probably complaining about how some crazy guy a motorcycle assaulted her with his bike and how her scooter was ok...

But seriously, that sucks man. I feel for you.

Quality Dan, you forgot most of them are Dolies claiming **** loads of benefits having never worked a day in their piss ridden lives :jack. For all those that do work and dont claim please accept my sincerest apologies for tarring you all with the same brush. :biggrin
 
Pleased to hear you are doing ok Mr VSenna after that one squire, and I rather hope you haven't woken up feeling too beat up today :thumbup

Careful with the recording of phone conversations. It won't be able to be used unless you have explained to her at the start of the conversation that you are recording it's content. If she agrees to continue the conversation knowing this, then ensure all your questions are direct and clear, otherwise she'll (read her solicitor) will claim that she was confused/deaf/stupid........which by the sounds of the accident, she quite possibly is already.

This maybe late or not but.
It was a traffic accident and damage was done.
Any other vehicle, you would have reported it. ie (called police)
Insurance company may want It registered with the cops.
You have witnesses and details.
The mobility scooter has insurance? If it has too, then the driver(of scooter) has responsibility for the actions... Just like any other insured user


Just some thoughts
 
Down my way they drive those bloodly things on the ROAD ! no tax , no insurance ,no MOT, no fuel tax !! **** IT dont get me started !!
