legal conundrum?

S

sharpei23

out for a ride last night to earith to raunds and back home on my rsvr with Duke 996S and CB250, yes that's right a nice girlie on a CB250, hadn't really thought it through though, cb top speed approx 70 on the flat straight made for a casual ride, ho hum
we took it in turns to follow the cb to make sure we kept together before a quick pint beside some great corners watching the world/bikes go past.
anyway, we stopped in Bedford for some fuel and had a minor incident, we left garage went to roundabout where a car separated us, cb fuel tap was turned off at garage and stuttered and stopped when tried to get going at roundabout, car didn't look properly, missed the stutter in front and knocked cb and rider over, all ok except broken front break lever and bent rear mudguard, who's fault, what do you think?
we'll see if any insurance action follows.
that apart, good roads and enjoyable evening trip, Duke obviously missed a few gears because front came up a couple of times (sic), I'm going to pay more attention to the 'how to wheelie rsv' thread in future.

its down to car driver behind to watch the road ahead for any incidents or cars , bikes stopping ect

Not saying this just because I'm a biker but the car is 100% at fault.

No different to a car stalling and them ramming them up the arse, is it?

Yep car drivers fault :thumbup

I ran into the back of a car years ago on a roundabout because he stalled setting off :roll i did the same thing a couple of years earlier too as i was watching for a gap and i thought the car in front had gone for it aswell :jack That'll teach the fookers to be too slow :biggrin my fault both occasions.

All rear end shunts are the fault of the person at the rear - they should leave enough space for anything going on in front.

did exactly same as sprocker, thought car in front had gone, it should have but it hadn't I twatted it while still looking onto roundabout. my fault completely.

Yep, car's fault. Don't even bother telling him the bike stalled, should have seen it. No legal doubt at all.

thanks, that's my view too.

will let her know and she can decide what to do - still probably best to move up to sv650 or a hornet, this time without a bloody top box that was spoiling my view............................of the road

when in waiting at a roundabout, or junction, i purposely refuse to look anywhere else than at the vehicle in front of me. once its gone, then i look
for traffic for me to pull out.
if you remember to do that, its a failsafe way of not arse ending cars at junctions

I do that too now :biggrin

100% car drivers fault, i take it insurance details were exchanged at the scene ? no matter how minor the damage why pick the bill up for someone elses mistake ? Tell your friend to get the insurance ball rolling :thumbup

I ran into the back of an A1 wondow screen van years ago, I was distracted by a pretty **** in a short skirt. All her fault but my insurance went up 200 :D
