What is the penalty for an exhaust that the police deem as being to loud?

I have just bought a pair of Mivv GP cans for my Mille. They sound soooooooooooooo good now I have removed the baffles/db killers. However I am worried that the police will constantly be on my back over the noise they produce maybe too loud for certain individuals.
I have heard many tales of fines, court and driving offences if the insurance is not notified, and was wondering if anyone on here knows the actual penalty you could receive as I'm sure many of you have nice cans that make your bikes sound as sweet as mine does?
 
Got a pair of these on mine a few months ago but run with the baffles in as they are bloody loud. The guy I bought them off said they were loud but not offensive and he ran with the baffles out! At the MOT the guy gave me an advisory notice the cans were loud but passed them. I told the insurance company and they were not bothered in the slightest and very cool about it. Not sure what plod could do you for if they are street legal. I love the noise especially when decelerating as they spit and burble like hell. The other great thing is that almost every car driver get out of the way now which they never did with the standard cans. They look the bollocks too.
 
I think they would give you a 'rectification notice' (I think thats what they are called) ... means you have to get it sorted in 7 days and prove it has been done. I'd make sure your insurance knew about the mod though just so the police dont take you down that route. Tbh a lot of the time i reckon it purely depends on which officer pulls you and which side of bed they got out of. i've had ones who wouldnt even listen to my story/reason and just fine/point me, through to ones who havent even mentioned the stuff. I was pulled on my 916 with termignonis on (with 'race use only' stamped on them), illegal visor, small number plate and not displaying a tax disc (it was taxed though) ... the copper (on a bike too) didnt mention any of the above things. i think the fact i wasnt speeding, was wearing full gear and was ok with him all meant he let me go with nothing.
oh ive just thought too, i think they will give you a standard £30 fine, not sure what reason they give but its just a ticket. no points

there's lots of things available to an officer and it will depend on which force area you are in.
it will range from a word of advice to a section 59 or ending up in court for a breach of the Construction and Use regulations.
the most common is a rectification notice, this gives you 14 days to refit the original one and take the bike to an MOT station who will verify you've fitted it and you take the paperwork to the police station
or
£30 fixed penalty

as said to inform your ins.co. as plod may well call them to see if you have told them and if you are still covered

Would it go down on record? Therefore you could get in more trouble for repeat offending say for a second or third time with loud cans.

I'll call insurance a.s.a.p. Hope it doesn't affect it too much as insurance is already £900.
 
I never got looked at with my Akra, and that has a warning on the can. If and when you ride near the police, don't rev it too much and they will leave you alone. But if one rides like a lunatic and sports an illegal number plate as well, they will add anything they can find and make something up to boot.....

i thought it was something along those lines mate but was never 100% sure (its been quite a while since ive been collared for being on the wrong side of the law) ...
i usually pull the clutch when a police car goes past the other way, stops the can blaring out right next to their window ;)

apart from the friendly advice it all goes on record. but sec 59's or ASBO's or court are very very rare for simply a loud can i would be very surprised if you found anyone that got more than a £30 FPN.

noise tests are possible at the roadside and if you look around the car forums it seems it is not unusual for the scooby/skyline drivers to get tested

i sometimes run my race Ackro and don't get any hassle

Well guys day two with the new cans and I got pulled by a copper on a bike, thought I'd get off wit a stern word since they are usually bike fanatics themselves, but no I got the only jobsworth on the bikes. Got a £30 fine and a producer .

He said if I keep getting pulled with the baffles out I would be classed as taking the piss and would prob get sec 59 or a court summons. But when I confronted him with questions like "how come the Harley boys and guys with custom choppers get away with exteamly loud pipes" he could not give me an answer. So I replied with "so you victimise sports bikes?" and he then said - "yeah pretty much"

It pisses me right off how some guys ride about on choppers ect wit straight through pipes and get away wit it like it's normal.

I did however get out of him, that if your cans have a manufacturers name and the BS/EU stamp or number then they are ok but baffles must be in gents lol.
 
Alex, that is unlucky. The reason you got pulled, is that biker cops tend to get strict the warmer the weather. Happened to my mate too. The never got pulled for a small plate, and on a very warm sunday, they got done for that and the can, whilst I, stood idly by, with the Akra on.
 
I was so pissed off! He was bragging about how many he'd prosecuted that day and also whilst he was making me put the baffles back in at the side of the road, a load of bikes went past and he got on his radio to othe coppers telling them to pull those bikes.

Thing is I have been riding an R6 for the past 4 years with a stubby can that put most thou's wit big brand can to shame and never got in trouble from the cops once!
 
Had a ride out to Helmsley today with baffles in buzzing along like a moped lol and no ******* police. Suppose it jus whether you dare risk it on a day to day basis.

I'm jus concerned about how harsh the punishment can be if I continue to reoffend with my sweet sounding cans?
 
Hi m8 ive got the mivv x-cones on my ape and it is LOUD:devious ,i got pulled over by the polis and all he did was tell his partner that he had the same bike with legal cans like mine whilst winking in my direction as if to say they weren't :jackthen all he done was check my license then jump back in his car:biggri.Just goes to show there are some robbocops out there:jack and some that cant be ****** ,its a bit like refferee's at the football some consistancy is all we ask:thumbup:biggrin
 
It's a bloody joke man. I'm also a great believer in loud cans save lives as people in cars can hear you coming so they are more aware of you.

Does anyone know about penalty for repeat offending with loud cans or is it jus a case of hitting you wit fines everytime

Loud cans don't save lives, a car with the window up won't hear you before you are too close for it to make a difference.

powers under Sec 59 are
(a) power, if the motor vehicle is moving, to order the person driving it to stop the vehicle;
(b) power to seize and remove the motor vehicle;
(c) power, for the purposes of exercising a power falling within paragraph (a) or (b), to enter any premises on which he has reasonable grounds for believing the motor vehicle to be;
(d) power to use reasonable force, if necessary, in the exercise of any power conferred by any of paragraphs to (a) to (c).
(4) A constable shall not seize a motor vehicle in the exercise of the powers conferred on him by this section unless-

(a) he has warned the person appearing to him to be the person whose use falls within subsection (1) that he will seize it, if that use continues or is repeated; and
(b) it appears to him that the use has continued or been repeated after the the warning.
(5) Subsection (4) does not require a warning to be given by a constable on any occasion on which he would otherwise have the power to seize a motor vehicle under this section if-

(a) the circumstances make it impracticable for him to give the warning;
(b) the constable has already on that occasion given a warning under that subsection in respect of any use of that motor vehicle or of another motor vehicle by that person or any other person;
(c) the constable has reasonable grounds for believing that such a warning has been given on that occasion otherwise than by him; or
(d) the constable has reasonable grounds for believing that the person whose use of that motor vehicle on that occasion would justify the seizure is a person to whom a warning under that subsection has been given (whether or not by that constable or in respect the same vehicle or the same or a similar use) on a previous occasion in the previous twelve months.
(6) A person who fails to comply with an order under subsection (3)(a) is guilty of an offence and shall be liable, on summary conviction, to a fine not exceeding level 3 on the standard scale.
 
Beg to differ bud but they will. Never heard a Renegade system at full chat?. :devious And as far as "close enough to make a difference" goes then yes, you may well be correct but that comes down to individual circumstances.

Another thing I find the noise is useful for is to alert dozy pillocks of pedestrians to your approach in town.

A riding buddy has a 1999 RSV with an Akra system on it and it sounds like a pea shooter compared to mine. I rode in to work last year and about 2 miles from getting there I ended up sat bimbling along behind a mate who is on my shift. As I rode over the Kincardine bridge behind his car I could see his head looking left and right and also upwards for some reason. When we got to work it turned out he was convinced there was a helicopter flying low over head until he spotted me in his mirrors. :biggrin

It's not only about outright decibels but also tone. Renegades have a very, very deep bassy tone which as far as I've experienced, is fairly unique. Even a mate who used to own a Colin Edwards replica Mille with the full 2-2 Akra race system said he believed his was nowhere near as noticeable as my Renegades when it came to sound qualities.

I've seen many a car driver as I'm following behind, snap his neck as he checks his mirrors to try and work out what the hell the noise is behind him.

Also, we have excellent quality double glazing on our house. The missus can hear me about a mile and a half away coming down the slip road off the motorway, shutting off the throttle, popping and banging on the over run and then can trace me by ear all the way home from there. :thumbup

but that comes down to individual circumstances
agreed but some riders think by fitting loud cans no one will ever pull out on them again:thumbup
