My understanding is in a court of law they have to prove anything you did was a contributing factor in a failure.
If that didn't stand they could refuse your warranty becuase you fitted fit ebc pads and not brembo or arrow cans and not Aprilia.

Trouble is you don't want to go to court to enforce common sense on them.
In reality my own experience has been that the warranty is as good as the dealer handling it. 99% of the time aprilia will never see the part that the claim is against before they authorise it to be replaced. So they rely on the common sense/competence of the dealer and that can be lacking especially if they don't want the job.

My advice is to use the dealer you purchased from if you possibly can cos they have an interest in keeping you sweet or failing that go to one of the dealers you get good recommendation for.
If your dealer insists it's warranty 9 times out of ten they will win the day.

where recalls are concerned they are legally bound to hounour the recall regardless of age or condition or owner of the vehicle. A recall is a binding declarartion to Vosa that the vehicle has an issue affecting safety.
 
little update:
just got off the phone with them and it sounds like they havent done anything yet, are continuing to say the crack is not the recall although i will get a new swingarm because of the recall, it sounds like they have not even looked at the crack yet so i dont know how they are sure its not the recall

thanks for all your support guys its really appreciated, i am well aware of aprilias warranty/recall behaviour in regard to paying dealerships the correct amount, thats why im trying to remain grateful the dealership is doing the recall at all

with a bit of luck i will have my bike back next week :biggrin cant wait to ride even if the weather is terrible this time of year
 
Your making progress and that's what counts.

Re the crack they should read the technical bulletin which concludes the crack starts from a weakness caused by the toe guard mounting riv nut being present in a stress area of the swinger.

The crack always starts at that riv nut and runs under the swinger and usually only gets your attention when it comes round the bottom and up the visible side. where has yours cracked - exactly there.
They are talking from somewhere dark and smelly but at least they are doing it which is what counts. beats me why they tell porkies cos people just find out and then they lose credability big time. :jack

ride home was awesome, weather total **** tho, wet leaves mud and mist in the cold darkness :puke what matters is i got her back and she's all sorted:inlove

dont know if they bled my back brake or i was just in back brake mode cus i skidded like 3 times without brakin hard :devious was a bit scared to grab the front with the weather so bad tho!

cant wait for some nice weather so i can go for a proper ride :devious

I keep gettin a letter tellin me to take the bike ( 04 model year ) to a dealer ( no names yet ) for the back brake sortin ................... I rang and said no worries brake works fine ............

Been on to dealer about my swingarm not gettin replaced yet ..... they aint interested :dunno
