Low side potential insurance issues?

Hi guys need some advise ASAP, had a fairly quick low side the other day on the RSV into some barriers.

Im thinking of claiming except i havent declared a few things

the bike is now white instead of black
the front tyre is fairly low


Will them two issues cause them not to pay out?

If it's below the legal limit the tyre issue may give them leave to dispute, you lost grip on the front & the bike slid. I know, & you know, that's bollocks but they will undoubtedly argue the case & it may be a protracted argument. The colour shouldn't be an issue.

If the tyre's illegal can you get the bike back & swap for a decent one?

The other thing to consider is what the bike will cost to repair at main dealer rates. If it's a Gen 1 and one side of panels/sticky out bits are affected for example they may take the view it's beyond economical repair & write it off. That's fine & dandy if you can buy the salvage & repair it cheaply, but it'll be recorded so value will plummet, your insurance premiums will rocket & you'll have to swallow any excess.

Personally, if you can repair it for less than say £500 I'd leave the insurers out of it.

you have changed the bikes colour ?

and the front tyre is low on tread?

if the tyre is legal no prob.

the colour is a major issue though so i think you got probs bud.

colour should also be logged with the dvla as also an offence to change main colour without notifying them

good luck and all i could say is hope the assessor dont need to look at it ?
 
Gotta disagree Lonners, although the DVLA may have an issue the insurers have to show why they'd reject/dispute a claim on that basis. If it was a theft claim they could say the change made the bike more desirable/nickable, & would have loaded their premium to suit. In this case it makes no material difference to the claim per se, but may have an effect on their write off value figure if non standard.
At a push they may agree to repairs back to factory standard, you'd have to stump up for any specialist paint, but I very much doubt it.

One point that's worth considering, if the insurers determine you were riding recklessly they can refuse a pay out. Recklessly in their eyes is far different to ours. So you must have hit an ice/diesel patch didn't you?

hummm i might just try and claim and see if it goes through and just hopefor the best, if they reject it ill just break the bike... :(

hope your right paul but he hasn't informed them of colour change ? and they wont like that sort of thing.
