Sadly not, as the title might suggest, me picking up a shiny new tuono.

Insurance assessors picked up my 2008 R after an altercation with a dozy bint who pulled a U turn on me as I was filtering past stationary traffic.

Im ok, bike has road rash all down one side - aargh!

On the positive side, it was a low speed spill, so bike looks repairable, on the negative side the @rse is contesting the claim, saying I shouldnt have been filtering on the chevrons.

Looking at the highway code, I *think* as long as the chevron boundary is broken white lines (which they were) and not solid, I should be ok - anyone had any similar experiences?

In either case, Im unlikely to get the bike back for a few months, so thats this summer done for me.

Oh, and of course, she was driving a Mercedes....
 
Think the broken lines rule is in yer favour? That's how I read it, saw TV program once where cops were booking drivers at junctions on motorways , and it was said that drivers must not cross the continuos white line they must wait until it is a broken line , so good luck
 
You are right about broken lines. There was a youtube clip of motorcycle cops crossing them. Can't remember what it was called, ride like a cop or summit.

Glad your ok and the bike aint too bad ..
This happened to an older mate of mine , woman did a uturn and knocked him and the missis off while he was filtering , a couple of broken bones etc and bike wrecked .. the police prosecuted her for it but still her bloody insurance company tried fighting it !!!!
He won in the end but it dragged out for 3 yrs ..
 
Good to hear you are ok and the bike is only superficial, you should be ok on broken white lines, good luck fella
 
Hi All,

Bike arrived back from the Insurers yesterday, 3 grands worth of "superficial" damage all repaired nicely.

3rd partys insurers admitted full liability at the end of August after they received the independent witness statement, which was a massive relief.

I dont think the outcome would have been the same had I not had the witness, so Ive a lot to thank him for.

Ive no lasting injuries, and the bike looks ok, though I havent ridden it yet.

Good result min....and kindo answers the question about filterin ower the broken chevrons if they accepted responsibilty and ye got 100% claim. :thumbup
