Where do I stand?

T

TinMan

Right, got a 2nd hand swingarm from ebay as mine was quite badly dented and had the spool ripped off where it was written off by the previous owner. Anyway, got it through the other day and its got a big deep scratch on the outside (most visible part).
Now the description was "in very good condition", which personally I wouldnt have described it as having a bloody great scratch in it. Problem being, I've looked harder at the photo's since and you can see the scratch, so its not as if he was hiding it. Anyone know where I stand regarding getting my cash back?
Cheers

If its not as add described then tell them you want your cash back or log a complaint with ebay

The best thing to do is contact the seller and say your not happy and they might just take it back as most people don't want negative feedback.....

Just talk to the guy and see if you can work it out.

If not, beat him silly with the swingarm. (and that is a joke....)

Well I've emailed him and asked him nicely if I can return it and get a refund and am awaiting a reply. Yeah, I paid via paypal. What about postage costs, do I get that refunded to or do I ahve to cut my losses?

Normally the seller will only refund the final price of the item and not postage costs.

If purchased via paypal then your covered to a certain degree anyway, if its not as described and the seller wont accept the return file a dispute through paypal.

Similar thing happen to me only the lady said it was 'MINT' and it had a big dent in it, emailed her and she refunded me and said I could keep the swinger, went straight in the bin!

The seller might argue that the damage was on show within the pictures but your argue is that he never mentioned it within his description. Hopefully the seller will agree to give you your money back but you will have to cut your losses on the postage.
Good luck let us all know how you get on. :thumbup

Very good condition does not mean damaged.
Bombard them with emails & open a paypal dispute for a full refund including P&P. You should get your money back but not the return postage.

Then leave the :jack negative feedback for wasting your time and money.

I'm always fair and reasonable on ebay but get fed up with people trying to pass off junk as mint condition, now sellers can't leave negative feedback if they rip you off let em have it :rant

The seller should have wrote in the add that it had a slight scratch on it , i would try to see if you can polish it out first , if it doesnt come out send it back your covererd through paypal mate .

I cant see it polishing out, it's too deep. Here is the pic with the scratch on (goes through the back "plug")

Still not heard back from him yet, although he could have gone away for christmas so not sure how long to wait for a reply....
