Got an old swingarm on my bike?

Got the un changed swingarm that should have been replaced when the recall was done, bike was originally bought from Taz motorcycles, do they now owe me a swingarm plus should they be liable to fit it for me?
 
hey bud, im not 100% whos liable taz / aprilia? but either way ur defo owed a new swingarm, how can ya tell which is which?
 
The swingarm was an official safety recal via DVLA which means that by law you have the right to a replacement.

Where it got sticky is that a few dealers charged Aprilia for the work and took delivery of the swingarm by using a customers Vin number but if their swingarm looked fine they would sell the new one on Ebay.

If you go to an Aprilia dealer they can look at all warranty claims against your Vin since new. I think they would even still supply a new one in most cases because it was a safety recall.
 
Are they for real? just got this from Aprilia after giving them my Vin number to check on there systems weather my bike needs the swingarm recalled, which it does, I get this:

I also called the place where the bike was originally bought from new, and they said my swingarm doesn't need to be changed? when it clearly does, bloody nightmare so far!
 
Aprilia Uk, who are kinda useless to be honest, and any Aprilia dealer should be able to check if theres outstanding recalls on your bike, they say they are 100% accurate, but clearly there not.
 
Aprilia contacted me again and basically said they've checked my VIN no. and the swingarm recall doesn't apply to mine so I guess im alright then, was abit confusing but heyho all sorted now.
 
Do us a favour take a couple of photos of your swingarm chain guard side and especially the lower guard mount and post them up

Don't want this happening to yours if it's suspect. My bike was manufactured April 04 and was in the recall so anything built before that will deffo be part of it.

i don't have the bike anymore. That was a pic i had on file from back in 05.
It's easy to tell if you have a problem. If you have a rivnut on the inside of the swingarm approx where the crack is in the pic and the the shark fin is mounted to it then you have the recalled type swingarm. The later verson does not have that mounting point which was the starting point for the crack.

Yep, I've just checked it properly myself, and its fine, I have no idea why Southern Cross told me its the old swingarm, As it has the bracket to which the shark fin is mounted to, as opposed to it being bolted to the swingarm, strange but there you go!
